What is meant by ‘No Win No Fee’?

‘No win no fee’ is a Government endorsed agreement with your lawyers stating that if they do not win the case, you will not have to pay. This means you pay nothing upfront and only pay legal costs if/when the case is successful. Payment of legal costs is dependent on whether or not you obtain a settlement from the case or tribunal.  There may be some expenses which your solicitors incur which you will have to pay win or lose.  These might for example be travel costs or the cost of any medical report.

Within employment law this is a method used to address the costs of the legal services whilst allowing you to make a claim without paying out first. Regardless of the nature of your claim as an employee, during the period the firm are trying to win your case, you will not pay us anything save for expenses. It is only if the case is won that you will incur the agreed charges. Typically, the amount paid if the case is won, is expressed as a percentage of the overall sum recovered.

There is a careful vetting process to assess the chance of success of the claim. So it is not guaranteed that your case will be offered a ‘no win no fee’ agreement. However the agreement aims to encourage the pursuit of claims that may otherwise not be investigated. This ensures people are getting access to justice and do not miss an opportunity for compensation in fear of being out of pocket.
