Non-compete Clauses in Employment Contracts

The government has launched a “call for evidence” to look at whether post-termination restrictions in employment contracts act as a barrier to employment innovation and entrepreneurship.

The government’s call for evidence also includes a review of whether non-compete clauses should be outlawed.

Interested parties should submit parties to the Department for Business Innovation and Skills by 19th July 2016. The terms of reference are: do such clauses hinder those who might be considering to set up, or have set up, an innovative enterprise and/or unfairly limit workers from moving freely between employers.
